2. Acceptance of these terms

By using this website, creating an account, purchasing an MPS licence or using any Word of Mouth digital product or service, you agree to these Terms & Conditions together with our Privacy Policy and Refund & Cancellation Policy. If you do not agree, do not complete the purchase or use the relevant digital service.

3. Products and services

Word of Mouth provides engineering, detailing and related professional services, and develops digital products including the MPS Configurator for Autodesk Inventor and WOM Engineering Tools browser-based calculators. Product descriptions, module availability, access or licence terms, pricing and technical requirements are displayed on the relevant product, calculator or configurator page.

Roadmap or unreleased modules shown on the website are informational only and are not supplied until clearly marked as available for purchase.

4. MPS licence model

An MPS purchase grants the customer a limited, non-exclusive, non-transferable right to use the purchased MPS modules for the stated licence term, subject to these terms and any technical activation rules displayed at purchase.

Unless otherwise stated, an MPS licence is linked to the customer account and email address used for purchase, is limited to the purchased modules, and may be subject to a stated device limit. The licence does not transfer ownership of the software, source code, dimensional data, libraries, intellectual property or underlying engineering content.

5. Monthly and annual digital access

Monthly and annual MPS licences and WOM Engineering Tools Pro access are currently sold as prepaid fixed-term digital access. A monthly term runs for approximately one month from issue and an annual term runs for approximately twelve months from issue. The exact issue and expiry dates recorded by the applicable licence or access service govern availability.

Yoco payments on this website do not currently create automatic recurring card deductions. Renewal or extension requires a new purchase unless Word of Mouth introduces an automatic-renewal product and clearly discloses that arrangement before purchase.

6. Pricing, VAT and currency

Prices are displayed in South African Rand (ZAR). Unless explicitly stated otherwise, MPS prices are shown excluding VAT. South African VAT at the applicable rate is added at checkout where required. The checkout displays the applicable subtotal, VAT and final amount before the order is placed.

7. Orders and payment

Online payments are processed by third-party payment providers, currently including Yoco. A purchase is not complete until the payment provider and WooCommerce confirm successful payment.

Before placing an order, the customer can review the selected product or licence, licence term, billing information, VAT and total amount, and can return to correct information before submitting the order.

Word of Mouth may decline or cancel an order where payment fails, fraud or misuse is suspected, pricing is clearly erroneous, the product cannot lawfully be supplied, or the order cannot reasonably be fulfilled. Where payment has already been collected and the order is validly cancelled by us, an appropriate refund will be processed.

8. Digital delivery and immediate activation

MPS and WOM Engineering Tools are digital products and access services. After successful payment, the relevant licence or account entitlement may be issued and activated immediately. By completing a digital-product purchase, the customer requests that digital provisioning begin as soon as payment is confirmed.

Where applicable law provides a cooling-off right, the effect of immediate service commencement will be determined in accordance with that law. Nothing in these terms is intended to exclude a statutory right that cannot lawfully be excluded.

9. Customer account

The customer is responsible for providing accurate account and billing information, maintaining the confidentiality of account credentials, and notifying Word of Mouth promptly of suspected unauthorised access.

The customer may not share account credentials or licence access in a way that exceeds the purchased licence rights or device limit.

10. Permitted and prohibited use

You may use MPS only for legitimate internal engineering, design, detailing or related commercial work within the purchased licence scope.

Except to the extent expressly permitted by law or by a written agreement with Word of Mouth, you may not sell, sublicense, rent, distribute, publish, extract or commercially redistribute MPS software, protected data, libraries or proprietary content; bypass licence controls; falsify device or entitlement information; or attempt to obtain access to modules that were not purchased.

Resale is permitted only under an authorised Word of Mouth reseller arrangement.

11. Intellectual property

All rights in MPS software, branding, protected libraries, underlying datasets, documentation, website content and related intellectual property remain with Word of Mouth or the applicable rights holder. No ownership rights are transferred by purchasing a licence.

Autodesk and Autodesk Inventor are trademarks of Autodesk, Inc. MPS is an independent Word of Mouth product unless expressly stated otherwise and is not represented as an Autodesk-owned product.

12. Updates, compatibility and technical requirements

Software compatibility may depend on supported Autodesk Inventor versions, operating systems, internet access, installation permissions and other technical requirements disclosed in product documentation. Customers are responsible for confirming compatibility before purchase.

Word of Mouth may issue updates, fixes, security changes or revised installers during an active licence term. We may discontinue obsolete versions where reasonably necessary for security, compatibility or support reasons.

13. Availability and support

We aim to keep the website, account portal, payment process and licence service reasonably available, but uninterrupted availability is not guaranteed. Maintenance, hosting failures, third-party outages, internet failures, security incidents or circumstances outside our reasonable control may temporarily affect service.

Support queries may be sent to sales@wordofmouthtrading.com or the support channel shown in the customer account.

14. Refunds and cancellations

Refunds, cooling-off rights, duplicate payments, defective or unavailable digital services and cancellation consequences are handled in accordance with our Refund & Cancellation Policy and applicable South African law.

Where a full refund is processed for an MPS purchase, the associated licence may be deactivated. Partial refunds do not automatically terminate the entire licence unless confirmed by Word of Mouth.

15. Records and invoices

Order records are retained in the customer account and/or our commerce systems as required for fulfilment, support, accounting, tax, fraud prevention and legal compliance. Tax invoices may be issued electronically and sent to the customer email address or made available through the account portal.

16. Privacy and personal information

Personal information is processed in accordance with our Privacy Policy and applicable South African law, including POPIA. MPS licensing may require processing of account identity, purchased modules, licence dates, device limits and activation records.

17. Liability and statutory rights

Nothing in these terms excludes or limits rights or remedies that cannot lawfully be excluded under the Consumer Protection Act, ECTA or other applicable law.

To the maximum extent permitted by law, Word of Mouth is not liable for indirect, incidental or consequential loss arising solely from customer misuse, unsupported modifications, third-party software changes, customer infrastructure failures or use outside documented technical requirements.

18. Suspension and termination

Word of Mouth may suspend or terminate access where a licence expires, payment is reversed or fully refunded, fraud is confirmed, account or licence controls are deliberately bypassed, or there is a material breach of these terms. Where reasonably possible and legally appropriate, we will provide notice and an opportunity to resolve the issue.

19. Changes to these terms

We may update these terms from time to time. The version applicable to a purchase is the version made available at the time of that purchase, subject to changes required by law or changes that do not materially prejudice existing rights.

20. Governing law and disputes

These terms are governed by the laws of the Republic of South Africa. Nothing in this clause prevents a consumer from using any statutory complaint, ombud, regulator or dispute-resolution process available under applicable law.
